1. Presentation and Acceptance
Welcome to Tripwai! These Terms and Conditions of Use ("Terms") govern the use of the Tripwai digital platform (corporate name Trip intercâmbio LTDA., CNPJ 44.869.512/0001-64), headquartered at Rua Samuel Heusi, 463, sala 907, Centro, Itajaí/SC, CEP 88301-320.
By accessing or using Tripwai's websites, applications or services, you (User) fully agree to these Terms. If you do not agree, we recommend not using the platform. This document is a legally binding agreement between you and Tripwai, establishing rights and obligations for both parties.
Tripwai may update these Terms periodically by publishing the revised version on our official channels; continued use after such changes constitutes acceptance of the new conditions.
2. Definitions
For purposes of this document, the following are considered:
- Tripwai: the digital platform for intermediation and online booking of courses, accommodations and exchange services, including self-service via app, on-demand human consulting and artificial intelligence features.
- User: an individual who accesses and uses the Tripwai platform to search, book or contract the services offered. The User declares to be of legal age (18 years) and have full civil capacity.
- Service Providers: independent Tripwai partners that offer products and services on the platform, such as educational institutions, accommodations, travel insurance companies, telephone operators and others.
- Exchange Services: set of services booked through Tripwai, which may include educational courses, accommodation, insurance, tickets or other complementary services.
3. Platform Purpose
Tripwai acts as an intermediary platform that allows Users to search, compare and book Exchange Services provided by various partner Service Providers.
Tripwai does not directly provide these course, accommodation, insurance or other services; instead, it facilitates contact, negotiation and contracting between the User and the respective suppliers.
4. User Registration and Account
To use certain Tripwai features (such as making reservations), the User must create an account, providing true, complete and up-to-date information, including name, contact, email and other requested data.
The User is responsible for protecting their account access credentials (login and password), committing not to share them with third parties.
In case of unauthorized use of the account or suspicion of security breach, the User must immediately notify Tripwai via email info@tripwai.com.
5. Platform Use – User Rights and Duties
By using Tripwai, the User agrees to comply with Brazilian laws and these Terms, always acting in good faith.
Information and Proper Conduct: The User must carefully read all information, rules and conditions provided by Tripwai and by Service Providers before making a reservation.
Travel and Documentation Requirements: The User is responsible for meeting the requirements necessary to carry out the exchange, such as: having a valid passport, visa or travel authorizations required by the destination country, proof of vaccination, school documentation, mandatory travel insurance, among others.
6. Reservations, Payments and Financial Services
Prices displayed on the platform are those in effect at the time of consultation and may be subject to changes according to availability and Service Provider policies.
Tripwai uses third-party payment processors (such as Stripe) to process transactions securely. When making a payment, the User agrees to the terms of service of the applicable payment processor.
7. Cancellations, Refunds and Changes
Cancellation and refund policies vary according to each Service Provider and will be clearly presented during the booking process.
Cancellation requests must be made through the platform or through Tripwai's official service channels.
8. Tripwai's Obligations and Responsibilities
Tripwai commits to keeping the platform operational and secure, adopting reasonable technical measures to protect Users' information and ensure service availability.
9. Limitation of Liability and Exemptions
Tripwai acts as an intermediary and is not responsible for the quality, execution or results of services provided by third parties (Service Providers).
We are not responsible for: cancellations or changes imposed by Providers; problems with accommodations, courses or other third-party services; visa refusal or denial of entry into the destination country; lost luggage, flight delays or transportation problems; accidents, illnesses or force majeure events during the exchange.
10. Data Protection and Privacy
Tripwai is committed to protecting Users' privacy and personal data. The processing of data collected by the platform is governed by Tripwai's Privacy Policy.
11. Final Provisions
Applicable Law and Jurisdiction: This contract will be governed and interpreted in accordance with the laws of the Federative Republic of Brazil. The court of Itajaí, State of Santa Catarina, is elected as competent to resolve any disputes.
By using Tripwai, the User acknowledges having read, understood and agreed to these Terms and Conditions of Use.
